Swimming Full Costumes, Large Towel, Swim Cap. Flip Flops, Gown in Winter are required
Hair must be Tied and swim caps worn.
Please no jewelry or chewing gum in the pool or pool area.
Lessons that are suspended due to the outstanding account will be forfeited and not rescheduled. Even if classes are suspended, all existing debt, including current term fees, will still be due and payable.
Lessons that you miss, will be FORFEITED unless a doctors note is provided and up to 2 lessons will be made up per term.
ONE TERM WRITTEN NOTICE IS REQUIRED on termination of lessons. Termination notice will only be accepted within the first week of the start of a new term. It is to be noted that the students time slot is secured and external enquiries are denied during term. Notice received during term or at end of term will be deemed received at the beginning of a new term of which payment will be accepted as due and payable for 1 x Term fees (Notice period).
Notice may be e-mailed to ACCOUNTS@12SWIM.CO.ZA. No other forms of notice will be accepted. Confirmation of receipt of notice is only upon written reply by the Swimming School. Should you not receive a written reply by email then the notice has not been received.
Students may not be in the water should there be lightning from as far as 15 to 20km radius. Dry land training or water safety will be discussed from pool side and may take place of the usual lesson time.
1. Non-Payment & Handover• "Should the Customer fail to make full payment of any invoice or outstanding amount within 30 days of the due date, the outstanding debt shall immediately become due and payable."• "12 Swim School and Aqua Centre reserves the right to hand over the overdue account to a registered debt collection agency or legal representative for collection, without further notice to the Customer."
2. Credit Reporting & Blacklisting• "Upon handover, the Customer acknowledges and agrees that the 12 Swim School and Aqua Centre will submit their details to relevant credit bureaus as a 'default' or 'slow-paying' consumer, in compliance with applicable consumer credit legislation (such as South Africa's NCA)."• "The Customer will receive a formal written notice of intention to list/blacklist from the debt collector/12 Swim School and Aqua Centre, giving the Customer a set number of business days to settle the debt before listing occurs."• "This negative listing will remain on the Customer's credit profile for the period prescribed by law, or until the debt is settled in full, whichever comes first."
3. Consequences & Costs• "The Customer shall be liable for all collection commission, tracing fees, legal fees (attorney and own client scale), and any other costs incurred by the 12 Swim School and Aqua Centre or the debt collector in recovering the outstanding debt."• "Removal from the credit bureau/blacklist is conditional upon full settlement of the capital debt, plus all accrued fees, charges, and collection costs."
4. Legal Action• "12 Swim School and Aqua Centre may, in addition to reporting to credit bureaus, institute legal proceedings (e.g., summons, judgment) to recover the debt and may seek an order for attachment of movable/immovable property."
